NOMADICPOD DRIVER TERMS OF USE

(INDEPENDENT SERVICE PROVIDER AGREEMENT)

This Driver Terms of Use (“Agreement”) is a legally binding contract between Nomadicpod (“Company”, “we”, “us”) and the individual or entity registering as a driver or service provider (“Driver”, “you”).

By registering, accessing, or using the Driver App or Platform, you agree to be bound by this Agreement.

1. ROLE OF DRIVER

You acknowledge that:

  • You are an independent contractor, not an employee, agent, joint venture partner, or representative of Nomadicpod.
  • Nomadicpod does not employ drivers or control their working hours, methods, or routes.
  • You are solely responsible for how you provide transportation services.

2. ELIGIBILITY & REQUIREMENTS

To become a driver, you must:

  • Be at least 21 years old (or legal driving age in your jurisdiction)
  • Hold a valid driver’s license for the class of vehicle operated
  • Own or have lawful access to an eligible vehicle
  • Provide valid identification and background information
  • Maintain insurance as required by law or platform policy

Nomadicpod may conduct background checks, document verification, and periodic re-evaluation.

3. VEHICLE REQUIREMENTS

Your vehicle must:

  • Be roadworthy and in good condition
  • Meet all regulatory and safety requirements
  • Pass inspection checks (where required)
  • Maintain valid insurance and registration

You are responsible for:

  • Fuel
  • Maintenance
  • Repairs
  • Cleanliness

4. DRIVER CONDUCT

You agree to:

  • Provide safe, professional, and lawful service
  • Comply with all traffic laws
  • Treat passengers respectfully
  • Refrain from discrimination, harassment, or misconduct
  • Avoid unsafe driving behavior

You must NOT:

  • Use drugs or alcohol while operating
  • Accept illegal trip requests
  • Engage in fraud or misrepresentation
  • Transport unauthorized passengers or goods
  • Off-platform negotiation to avoid fees (where prohibited)

5. TRIP ACCEPTANCE & FULFILLMENT

  • You may accept or decline ride requests, subject to platform rules
  • Excessive cancellation may lead to penalties or suspension
  • You must complete accepted trips unless valid safety or legal reasons apply
  • You must follow reasonable navigation routes unless agreed otherwise

6. FARES & PAYMENTS

You acknowledge:

  • Fares are calculated by Nomadicpod systems or third-party rules
  • Nomadicpod may deduct service fees, commissions, and applicable charges
  • Earnings are subject to adjustment for refunds, fraud, or disputes
  • Payment timelines depend on payout schedules

Nomadicpod does not guarantee minimum earnings.

7. RATINGS & PERFORMANCE

Passengers may rate your performance.

You acknowledge:

  • Ratings affect visibility and access to trips
  • Repeated low ratings may result in suspension or termination
  • Fraudulent manipulation of ratings is prohibited

8. CANCELLATIONS & PENALTIES

You may be penalized for:

  • Frequent cancellations after accepting trips
  • Failure to arrive at pickup locations
  • No-shows without valid reason

Penalties may include reduced priority or temporary suspension.

9. SAFETY & INCIDENTS

You must:

  • Prioritize passenger safety at all times
  • Report accidents or incidents immediately
  • Cooperate with investigations
  • Maintain emergency readiness

Nomadicpod may suspend drivers involved in safety violations pending review.

10. INSURANCE & LIABILITY

You are responsible for:

  • Maintaining valid motor insurance
  • Ensuring coverage for passengers as required by law

Nomadicpod does not provide insurance coverage unless explicitly stated.

You are liable for:

  • Traffic violations
  • Damages caused during trips
  • Illegal conduct

11. BACKGROUND CHECKS

Nomadicpod may:

  • Conduct criminal, driving, and identity checks
  • Re-run checks periodically
  • Disqualify or remove drivers based on results

12. PLATFORM ACCESS

Nomadicpod may:

  • Suspend or terminate access at any time for violation of rules
  • Restrict access based on performance, safety, or legal issues
  • Modify platform features without notice

13. NON-EXCLUSIVITY

You are free to:

  • Work with other platforms
  • Operate independently
  • Accept or decline requests at your discretion (subject to penalties for accepted-trip cancellations)

14. DATA & PRIVACY

You agree that:

  • Nomadicpod may collect and process your data for platform operations
  • Location data may be used for trip matching and safety
  • Data may be shared with passengers where necessary for service delivery

15. CONFIDENTIALITY

You must not:

  • Share confidential platform data
  • Reverse engineer or misuse app systems
  • Exploit pricing or dispatch systems

16. TERMINATION

This Agreement may be terminated by:

You:

  • By discontinuing use of the platform

Nomadicpod:

  • For violation of terms
  • Fraud or misconduct
  • Safety risks
  • Legal compliance reasons

Termination may result in loss of access to earnings or platform privileges.

17. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Nomadicpod is not liable for indirect or incidental damages
  • Nomadicpod is not responsible for passenger conduct
  • Nomadicpod is not responsible for trip-related losses or disputes

Your relationship is directly with the passenger for service execution.

18. DISPUTE RESOLUTION

  • Drivers must first contact Nomadicpod support for dispute resolution
  • Unresolved disputes may proceed to mediation or arbitration
  • Arbitration decisions may be binding where legally enforceable

19. FORCE MAJEURE

Nomadicpod is not liable for delays or failures caused by:

  • Natural disasters
  • Government actions
  • Network or system failures
  • Pandemics or emergencies
  • Events beyond reasonable control

20. CHANGES TO AGREEMENT

Nomadicpod may update this Agreement at any time. Continued use of the Driver Platform constitutes acceptance of changes.

21. GOVERNING LAW

This Agreement is governed by the laws of the Federal Republic of Nigeria.

By registering as a driver on Nomadicpod, you confirm that:

  • You have read and understood this Agreement
  • You accept all terms and obligations
  • You agree to operate as an independent service provider
